How many SCOTUS confirmations for DJT?

Ginsburg to miss oral arguments again next week

Question : Is it possible that she's on life support?

She's had colon cancer, pancreatic cancer, and just had surgery some weeks back for lung cancer. She has been missing oral arguments and now won't be going to work next week either.

Trumps already getting ready for his next Supreme Court justice nomination. I don't think Ginsberg will make it to the Summer.

How quickly does a person of her age and general health return to work after such surgery?

She must have thought she was in generally good health, or didn't want Obama to appoint her replacement.

Scalia died on 2016.02.13, setting up the "no final year SC appointments" precedent. So the real question is, if Republicans lose the senate in 2020, would Democrats allow any appointments if Trump wins in 2020? Seems unlikely, which all but obligates Republicans to ignore that precedent. And if they do that, the left will lose it. Year of Cthulu?

During the hearing for Kavanaugh, a Democrat (Booker maybe?) pointed out in response to Kavanaugh's comments on the partisan attacks against him, that they (Democrats) did not have any such issues or concerns with Gorsuch. So to some extent, it is almost as if they didn't realize how out of control they got, although I suspect most of it was due to being an election year. Still, that they went as far is still a surprise. But it apparently doesn't concern people willing to vote for them, so maybe that will be their new normal.

Back in August she was treated for pancreatic cancer again. She missed Nov 13th. She was transferred from one hospital to another on Friday (not sure what happened between the 13th and Friday) and released today. I think the issue was "fever and chills." I can't help but think of the Black Knight scene in Holy Grail. Pancreatic cancer isn't usually one of the "most likely to survve" types.

I remember about six to eight months ago the Democrats were already starting to talk about how they can fake it and how long they could get away with it when she's dead. For example the Justice can actually send minions in her place to do a lot of things at the court. Close to know if it's not actually her sending them. It's Weekend at Bernie's all over again!

Senate minority Leader Chuckie Schumer, opines that Bader-Ginsburg's replacement should wait until we have a new President. So if Trump is reelected, Chuckie proposes to wait until 2025 to replace Bader-Ginsburg?

I'd rather not have much off topic discussion here, but I'm guessing he is referring to the delay which afforded Trump the selection (Gorsuch) after Scalia's death. If I thought thought the Democrat party would agree with reasonable standards and practices of precedent, I'd agree. I can't imagine any nomination would be completed by election, but I certainly hope it is.

The tables are turned on both parties with the death of RBG. Where the GOP was advocating for the election before Scalia's replacement, and the Dems wanting Obama and the Senate to install a new member immediately. Now the Dems are saying wait until after the election and the GOP wanting quick action.

A Trump appointee has the potential to change the Supreme Court for a generation.

Merged the discussion posts from the RIP thread.

I should add that McConnell makes a reasonable argument that regaining control of the senate in 2014 adds some credibility. And by extension, retaining control in 2016 and 2018. Also, RBG's politicization of her position and nomination of her replacement justifies it (IMO). If Republicans do not move forward with a nomination, any future Democrat controlled senate will completely upend any historical precedent and go to simple majority. The manner in which they passed the ACA and most of their behavior since provides the example.

Leading Democrat members could offer that holding off on nominations is appropriate when there will be a change in president. That is, in the last year of a president's second term. This would match the delay for Scalia's replacement. But I guarantee you they wouldn't uphold that agreement if the tables were turned. The problem there is of course when the Democrat party tries to overturn an election between Nov and January. 2000 wasn't settled until December, by the SCOTUS.

As well, politically motivated judges should act appropriately when deciding whether to inconveniently die on the bench or retire while their political affiliation would make the nomination. RBG had health issues in '99, '09 and '14 (at least). So she had ample warning to make that politically informed choice.
